Identity and Address of the Data Controller. In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (in Spanish: Ley Federal de Protección de Datos Personales) (hereinafter "LFPDP"), the legal entity known as Casa Hogar de Cabo San Lucas, A.C. (hereinafter "Casa Hogar"), declares through its representatives that it is a Civil Association legally constituted in accordance with Mexican law, with address at Calle Playas s/n, between Playa El Médano and Playa del Amor, Colonia Cerro de Los Venados, C.P. 23473, in the city of Cabo San Lucas, Los Cabos, Baja California Sur. Its corporate purpose includes, among others, promoting, subsidizing, and providing welfare, educational, and recreational services to foster the comprehensive development of children, contributing to family and community progress. Casa Hogar, in accordance with the Constitution of the Civil Association dated July 8, 1991, is responsible for the processing of your personal data.

Collection of Personal Data. To comply with the provisions of the LFPDP and for the purposes set forth in this Privacy Notice, we inform you that we may collect your Personal Data in the following ways for Beneficiaries, Volunteers, Employees, Suppliers, Donors, and Visitors:

  • - Directly from you: through direct interaction with Casa Hogar.
  • - Through paper or digital forms.
  • - Through email.
  • - Through the Casa Hogar website.
  • - Through social networks, WhatsApp, or any other digital medium.
  • - From public sources, files, or records.
  • - Through other sources permitted by law.

Personal Data and Sensitive Personal Data Processed by the Data Controller. Casa Hogar informs you that, to comply with the purposes indicated in this Notice and those of its corporate purpose, it will process identification data, contact personal data, employment data, asset-related, financial, tax data, and/or data related to your family members. By providing personal data related to your family members, you acknowledge that you have their consent for Casa Hogar to process their data for the purpose of contacting them. Specifically:

  • Landline and mobile phone numbers.
  • Email address information.
  • Date of birth.
  • Address.
  • Curriculum information.
  • Employment data.
  • Educational records.
  • Professional license.
  • Blood type.
  • Sex.
  • Data related to physical, emotional, and mental health.
  • Medical prescriptions and data on the consumption of medications or supplements.

  • Laboratory data.
  • Historical data (hobbies, activities, interests).
  • Federal Taxpayer Registry (RFC).
  • National Electoral Institute Voter ID (INE).
  • Passport.
  • Immigration document.
  • Unique Population Registry Code (CURP).
  • Birth certificate.
  • Driver's license.
  • Vehicle data (make, model, year, license plates, insurance policy).
  • Social security number.
  • Medical insurance policy number.
  • Infonavit data.
  • Afore (retirement fund) data.
  • Child support data.
  • Emergency contact information.

  • Fingerprints.

Additionally, data related to navigation of www.casahogarcabo.com (hereinafter the "website"):

  • Your IP address.
  • Your type of navigation and browser.
  • Cookie information provided by you.

Processing of Sensitive Personal Data.  In accordance with the LFPDP, Casa Hogar informs you that it collects and processes Sensitive Personal Data, as well as asset-related or financial data of Beneficiaries, Volunteers, Employees, Suppliers, Donors, and Visitors.

Casa Hogar recognizes the great importance of your Sensitive Personal Data; therefore, it will take special care in the processing and safeguarding thereof and commits to ensuring that such data is handled under the highest standards and strictest security measures to guarantee confidentiality, to the extent possible for Casa Hogar.

Primary Purposes. Casa Hogar will process your personal data for the following primary purposes, which are necessary to fulfill our corporate purpose:

  • Information and provision of services.
  • Diagnostics.
  • Updating internal databases.
  • Updating external databases.
  • Identification.
  • Your identification.
  • Your location.
  • Administration of physical access to Casa Hogar facilities.
  • Administration of electronic access to Casa Hogar systems and technological infrastructure.
  • Administration of Casa Hogar services and areas.
  • Receipt of labor.
  • Creation and implementation of analytical and statistical processes.
  • Video surveillance.
  • Preparation of corresponding contracts.
  • Issuance of corresponding invoices.
  • Making corresponding payments.

In summary, to carry out all activities necessary to promote, subsidize, and provide welfare, educational, and recreational services to foster the comprehensive development of boys, girls, and teens, contributing to family and community progress, and any analogous or compatible purpose with the foregoing, as well as those arising from the various resolutions issued by any General Assembly of Members of Casa Hogar.

Additionally, Casa Hogar will process the personal data of third parties designated by you in any applicable document, in order to contact them in case of emergency.

Finally, we inform you that you may not object to Casa Hogar ceasing the processing of your data for the primary and necessary purposes mentioned above, as such processing is necessary to fulfill the obligations arising from the legal relationship established between you and Casa Hogar.
Secondary Purposes. Additionally, if you do not object, Casa Hogar will process your personal data necessary for secondary purposes related to improving and fostering a better neighborhood environment (such as the dissemination of greetings and other celebrations and special days). Likewise, your personal image (whether in photo, audio, video, etc.) may be used in the preparation of informational and promotional material.

  • Dissemination of training programs.
  • Storage of digital files, which will be used through the website in compliance with Casa Hogar's internal and external objectives.
  • Preparation of follow-up and care files.
  • Generation of reports on actions carried out and beneficiaries.
  • Accountability to funders and donors.
  • Sending notifications about events and activities carried out by Casa Hogar.
  • Performing data analysis and statistics on work results.
  • Maintaining links with individuals related to the work.
  • Conducting quality and satisfaction evaluations of the services provided by Casa Hogar through the website.
  • Informational purposes: to notify Users about events, activities, and other services offered by Casa Hogar through the website.
  • Making services and advertisements available to Users for marketing purposes.

If you do not wish for your personal data to be processed for any or all of the secondary purposes, you may notify us at any time by email at executive-director@casahogarcabo.com, or in writing delivered to the address indicated at the beginning of this Notice.

Refusal to allow the use of your personal data for additional purposes may not be a reason to deny you the requested services or to terminate the relationship established with us.
Transfers. To comply with the necessary purposes described above or those required by law or by competent authorities, Casa Hogar will transfer the necessary personal data to the following parties for the following purposes:

If you do not wish for Casa Hogar to transfer your personal data for those transfers for which your consent is required, please send an email to executive-director@casahogarcabo.com, where your request will be addressed in due time and form, or submit it in writing to the address indicated at the beginning of this Notice.
ARCO Rights and/or Revocation of Consent. You or your legal representative or attorney-in-fact may exercise any of the rights of access, rectification, cancellation, or opposition (hereinafter "ARCO rights"), as well as revoke your consent for the processing of your personal data, by sending an email to the Board of Directors of Casa Hogar at executive-director@casahogarcabo.com, or in writing delivered to the address indicated at the beginning of this Notice.
Limitation and/or Disclosure of Your Data. You may limit the use or disclosure of your personal data by sending your request to the Board of Directors of Casa Hogar at executive-director@casahogarcabo.com, or in writing delivered to the address indicated at the beginning of this Notice.
Habeas Data. When the Board of Directors of Casa Hogar, required to rule on the rights of access, rectification, cancellation, or opposition to the publication of personal data, fails to issue a decision within the applicable period or issues a determination that does not satisfy the request, the applicant may initiate Habeas Data proceedings before the Association's Board of Directors by submitting a written request to any of its members.
Such written request must include at least the following information: i. The name of the interested party and, where applicable, of their attorney-in-fact or legal representative, as well as the document evidencing such representation or legal status; ii. The arguments demonstrating their interest in filing this means of defense; iii. The arguments by which they challenge the considerations of the contested determination. When contesting the lack of a decision, the expression of such arguments shall not be necessary; iv. Where applicable, supervening evidence supporting their claims; and v. The applicant's signature.
If the claim raised in the Habeas Data proceeding is deemed well-founded, the Board of Directors shall specify the information to which access must be granted or that must be deleted, rectified, updated, or declared confidential or reserved, establishing a deadline for compliance, which may not be less than five business days.
Amendments to the Privacy Notice.  Casa Hogar reserves the right to make any type of modification or update to this Privacy Notice in order to fully comply with new legal provisions, new internal policies, or requirements from any competent authority. Such modifications and/or updates will be made known immediately after their entry into force through publication on the website, in the Privacy Notice section, where the updated version will be available.
Within five calendar days following the effective date of this Privacy Notice or any subsequent updates, you must express your opposition or consent to the new use of your Personal Data by sending an email to executive-director@casahogarcabo.com.
Once the aforementioned period has elapsed, your tacit acceptance of the guidelines and provisions established in this Privacy Notice shall be understood.
Consent.  For the purposes of the LFPDP and other applicable legislation, you declare that this Privacy Notice has been fully disclosed to you by Casa Hogar, and that you have read and agreed to the terms set forth herein. Accordingly, you grant your consent to the processing of your personal data.
